Florida’s new restrictions on nitrous oxide sales are now in effect, bringing felony penalties for certain violations at covered businesses. RHINO Lawyers is helping clients understand Meg’s Law and responding to related criminal charges.
Tampa, FL, Oct 7, 2026 — RHINO Lawyers is helping clients understand Florida’s Meg’s Law, also known as SB 432, which took effect Oct 1 and restricts covered dealers from possessing, selling, delivering or giving nitrous oxide from licensed premises. The restrictions reach convenience businesses and tobacco and nicotine dealers, including smoke shops and vape shops.
Named in honor of Meg Caldwell, the law addresses recreational nitrous oxide use, sometimes referred to as laughing gas. A violation by a covered dealer, agent or employee is a third-degree felony. The law also includes exceptions, including finished food products in which nitrous oxide is used solely as a propellant.
The statute directs the Department of Business and Professional Regulation to adopt rules aimed at preventing nitrous oxide misuse for intoxication. Grocery stores and supermarkets licensed in Florida are excluded from the prohibition.
“New laws can leave people with questions about what they can and cannot do,” said Brandon F. Jones, Esquire, sole shareholder of RHINO Lawyers. “The goal is to explain the law clearly, look at the facts and provide legal guidance when someone is facing a charge.”
The change gives Florida businesses and employees another reason to understand how the statute applies to their operations. For people facing felony crimes, the consequences can extend beyond the case, making early legal guidance important. RHINO Lawyers’ criminal defense lawyers include former State Attorneys and prosecutors who assess the facts, review evidence and develop a defense strategy based on the circumstances.
The firm brings more than 65 years of combined legal experience and represents clients in criminal defense matters, including felony, misdemeanor, DUI and traffic cases. RHINO Lawyers also handles injury claims involving auto accidents and other crashes, giving clients a single firm for matters when they are injured or arrested.
“The earlier an attorney can review a case, the more time there may be to understand the evidence and determine the response,” said Sheila Mosakowski, Esquire, litigation attorney at RHINO Lawyers. “Every case has its own facts, so the legal strategy has to fit the situation.”
RHINO Lawyers will continue assisting clients as Meg’s Law becomes part of legal and business decisions in Florida. The firm encourages anyone facing a related charge or legal question to seek counsel promptly rather than trying to navigate the issue alone.
